Pakistan Tehreek-e-Insaf (PTI) has filed a petition in the Supreme Court against the 26th Amendment, claiming that it is unlawful, illegal and unacceptable.
The petition submitted by lawyer Sameer Kosa on behalf of the PTI seeks to cancel the amendment, and calls for the halt to the judicial appointment of Pakistan’s Judicial Commission until the verdict is reached.
The PTI argued that the amendment violates the basic structure of the constitution, which is not authorized to change parliament. The party also states that this amendment compromises the freedom of the judiciary, a major constitutional policy.
The Supreme Court is planning a hearing on the case on January 27 at the court room No. 2 under advanced security arrangements.

The 26th Amendment passed by Parliament at midnight January 20-21, controls the Chief Justice of Pakistan for three years. It also introduces the National Legislative Assembly and the Senate members of the 12 -member parliamentary committee from selecting the Chief Justice from a three senior judges. The elected name is sent to the Prime Minister and then the President for approval.
In addition, the amendment is established by the Supreme Court’s appointments, in which the Chief Justice, three senior judges, lawmakers, law minister, Attorney General and Pakistan Bar Council candidate are in effect for at least 15 years.
